If you are buying products to resell in the state of Oklahoma, you can qualify for a sales tax exemption on that purchase by presenting your Oklahoma resale/exemption certificate.
It’s important to note that you should only use an Oklahoma resale certificate if you truly intend to resell, lease or rent the items or use them as parts or ingredients in products for resale. It is illegal to use a resale certificate for purchases you intend to use yourself.
Here’s what you need to know as a seller about using an Oklahoma resale certificate, or if one of your customers presents an Oklahoma resale certificate to you.
If you Wish to Use an Oklahoma Resale Certificate
For purchasing items for resale in Oklahoma, you can avoid paying sales tax by completing a Uniform Sales and Use Tax Certificate (Multijurisdictional) from the Multistate Tax Commission to buy items for resale from Oklahoma vendors. Also keep in mind that vendors reserve the right to refuse to accept a resale certificate.
Also keep in mind that if you have an Oklahoma sales tax permit, you are required to collect sales tax from your Oklahoma buyers.
If You are Presented with an Oklahoma Resale Certificate
You are responsible for a few things when it comes to accepting an Oklahoma resale certificate from a buyer. If you fail to do any of these things and face an audit, you will be the party on the hook for fines and penalties.
- Make sure the resale certificate is properly completed – Ensure the resale certificate is fully filled out and signed. It must include your buyer’s sales tax permit number.
