Economic nexus laws by state: Ohio

State laws on nexus vary and it’s hard to keep up if you’re doing business in multiple states. We’ve done the research for you and here’s all the information you need to know about sales tax nexus in Ohio.

What’s the threshold for economic nexus in Ohio?

  • Threshold: Sales of $100,000 or more annually or 200 or more separate transactions into the state in the current or last calendar year.
  • Summary: According to the state, sellers that meet either the sales or transaction number thresholds are required to register for an Ohio sales tax permit, collect sales tax on sales that ship into Ohio, and remit sales tax to the state.

What’s the threshold for commercial activity tax in Ohio?

  • State: Ohio
  • Threshold: Sales into Ohio exceeding $500,000 in the current or preceding calendar year
  • Summary: According to the state, sellers who meet the threshold are subject to the Commercial Activity Tax (CAT) and are required to register for an Ohio sales tax permit, collect sales tax on sales that ship into Ohio, and remit sales tax to the state.

When did this Ohio law go into effect?

This law went into effect August 1, 2019.

What types of nexus qualifiers are common in Ohio?

Ohio has defined a type of physical nexus referred to as “cookie nexus.” According to Ohio, if a retailer places software on Ohio consumers’ devices or uses in-state server providers, this will establish a physical presence in Ohio.

In addition, Ohio also has passed Economic Nexus legislation as well as what they refer to as a Commercial Activity Tax (CAT) that designates that sellers exceeding $500k will need to register, collect and remit in their state.
